Purchase contract
The sole subject of the purchase contract entered into by Seller and Buyer are the products listed on freshoptical.com web-shop.
Detailed product information including features are available in the item description of the product. Please take your time and carefully study the item description to order the product that best meets your needs. Should you have any questions or concerns, do not hesitate to contact our staff for further assistance.
Should the use of any of our products pose potential hazards, these are explicitly stated in the item description.
We do our best to present accurate pictures of our products, however, some images may only be illustration.
Purchase price is the gross price stated next to the exact item name.
You may personally pick up the items ordered in any of our stores. Mail delivery upon request.
Placing an order, the Contract
You become a client of Fresh optical Club Network Ltd. by placing an order through the web-site. Your order may only be regarded as confirmed upon the receipt of a written notification by our CS Department.
Placing an order:
- User registration is necessary (a valid e-mail address and phone number is required)
- After completing registration you may sign in. Choose the item you wish to order and place it into the shopping cart by clicking the CART button.
- In 'My cart' you can see all the items placed into your shopping cart.
- If you do not wish to order any further product, click 'Order'.
- On the order page you may change order quantities. To do so, click 'Recalculate'.
- You may also select the delivery condition (pick up personally in one of the stores or mail delivery) that best suits you.
- Prior to placing your order please check the items ordered and your shipping and billing data – you may correct any mistakes now.
- If you are ready to place the order, click 'Submit order'.
- An automatic reply message is sent – please do not respond to it. Should you need assistance, contact the CS department.
- You may also place an order by phone or via e-mail.
Privacy
We process the information we collect in order to identify the user confidentially, use it exclusively to deliver you the product selected and we do not forward it to third parties. The e-commerce service of Fresh Optical Club Network Ltd. is available to registered users signing in with their personal user ID and password. Buyer is identified by the password; providing the password is regarded as acceptable evidence that the order is placed by the User. Orders are processed electronically and automated reply message is sent as an acknowledgement of the placement of the order. Users shall be held liable for using and storing their passwords adequately and may not disclose it to third parties. Fresh Optical Club Network shall not be held liable for any and all damages suffered by User or any third party as a consequence of illegitimate use of the password of the User. Official language of the contract: Hungarian. The contract entered into by placing an order shall be regarded as a legally binding written contract. It is stored by Fresh Optical Club Network Ltd. and is later identifiable and retrievable.
Payment and shipping
Mail delivery of products ordered at freshoptical.com: HUF 990/ delivery (regardless the number and weight of items ordered) Buyer may chose to pick up the items ordered in our stores. In case of store delivery no delivery charge is applied. Prior to placing your order you may select the delivery condition that best suits you by checking the appropriate delivery type. Invoice is included in the package and handed over upon delivery. Payment is due at delivery. Should you need an e-invoice, prepayment is required via wire-transfer.
Warranty
In accordance with the regulations of the Civil Code (Act IV/1959), in Hungary a warranty period of 2 years is required for all products acquired as new (3 years for durable goods), should there be a consumer contract in effect (consumer contact being an agreement by and between a person who is a party to the contract outside the sphere of their economic or professional activities and an entity inside the sphere of their economic or professional activities).
In accordance with Government Decree 151/2003, Fresh Optical Club Network Ltd. is liable to provide a warranty period of 1 year for products specified in the Appendix of the Decree.
In case of certain products, the manufacturer may opt for warranty conditions more favorable than those required by law. Should these conditions apply, Fresh Optical Club Network Ltd. is required to pass these conditions on to the consumer. Terms and conditions for claiming a warranty period longer than 12 months is specified on the warranty card included in the packaging of the product. Should you be interested in these conditions prior to placing an order, we are happy to provide you with this information.
Terms and conditions of exercising the right of warranty are specified by the Civil Code and the Decree 49/2003 of the Ministry of Economy and Transport. Fresh Optical Club Network Ltd. is required to honor the right of warranty, should the product sold fail to meet features and characteristics specified by law or stated in the contract at the time of delivery.
Warranty is acknowledged, should parties disagree regarding the cause of the defect of the product, once Buyer manages to prove the cause of defect (expert opinion). Should any defect occur during the first six months commencing on the date of delivery, it is necessary to establish whether the defect existed at the time of delivery. During the first six-month period Seller is to bear the burden of proof.
If Buyer is aware of the defect of the product, or must have been aware of it, Fresh Optical Club Network Ltd. shall not be liable for these defects and is excused of any and all pertaining liability.
Terms and conditions of express warranty are specified by the Civil Code, Government Decree 151/2003 and Decree 49/2003 of the Ministry of Economy and Transport. The basis of claiming express warranty is an adequate express warranty document. Seller shall be liable to make express warranty until proving that the defect of the product is due to the inadequate use of thereof.
In the case of deficient performance, the Buyer shall be entitled to request repairs or replacement of the defective item at his discretion, unless meeting such demand would result in excessive additional costs for Fresh Optical Club Network Ltd., taking into account the value of the item provided, the extent to which the contract is breeched and any and all inconvenience caused by the defectiveness of the product.
If Buyer is not be entitled to repair or replacement or should Fresh Optical Club Network Ltd refuse to repair the defect; or repair is not possible within a short time, without any loss in value, and without causing injury to the Buyer's interests – at his discretion – Buyer is entitled to request appropriate price reduction or may rescind the contract. Insignificant defect shall not constitute the basis of rescinding the contract.
Enforcing your rights
We hereby request our customers to carefully inspect the product upon delivery and prior to signing the delivery note, in order to be able to prove that any item is missing. Should any quality problems arise, the warranty claims are processed in accordance with the regulations of Decree 49/2003 of the Ministry of Economy and Transport. The basis of filing warranty claims is the documentation proving purchase. Fresh Optical Club Network Ltd. is required by law to keep a record all claims made. Fresh Optical Club Network Ltd – in accordance with legal requirements – intends to repair or replace any defective item within 15 days. Should you have any quality concerns, our should the product you purchased be defective, please contact us immediately.
Right to rescind the contract
In accordance with Section 4 of Government Decree 17/1999, Buyer may rescind the contract without giving reasons for their decision within 8 days commencing on the date of delivery of the product. Should Buyer opt to rescind the contract, Fresh Optical Club Network Ltd. is required to refund the purchase price without any delay, but no later than 30 days following the return of the product. Buyer shall be liable for paying any and all charges and fees for returning the product.
Fresh Optical Club Network Ltd. may claim damages for any and all defects that occurred due to the inadequate use of the product. Buyer shall not be held liable for any other expenses.
In accordance with Section 5 of Government Decree 17/1999, Buyer may not exercise their right to rescind the contract in case of:
- contracts about the purchase of voice-, or image recordings and computer software, unless the packaging is intact
- goods specifically designed, manufactured or assembled for the consumer, upon their specific request, following specific requirements (eg: unique configurations)
Intellectual property
Any and all technological and graphic construct, illustration, item description, photo and data concerning the company or any of its products as appears on this web-site is the sole property of Fresh Optical Club Network Ltd. Their reproduction or use in any form without the prior written consent of the owner of rights constitutes a breach of intellectual property rights and will result in legal action against any infringing party.
If you wish to refer to www.freshoptical.com, the site may not appear as part of any other web-site. Any other reference or link to our site is welcome and is hereby authorized.
Other conditions
Placing an order in the web-shop of freshoptical.com presupposes that Buyer is aware of the opportunities and hazards inherent in using the world wide web, and the acceptance of thereof – with special regards to technological performance and potential errors that may occur during the use of thereof.
Fresh Optical Club Network Ltd. shall not be held liable for any malfunction of the network that may render the operation of the website impossible or impede the placement of an order.
Fresh Optical Club Network Ltd. reserves the right to sue any person, legal or natural that commits fraud or intends to do so.
Fresh Optical Club Network Ltd. shall not be held liable for any fraud committed by third parties and resulting in damages suffered by a registered user.
Should a user breach the terms and conditions of placing an order, Fresh Optical Club Network Ltd. reserves the right to regard the registration of such user invalid.

Any and all item listed on the site is original, brand-name product. If you are not sure about your choice, we suggest that you visit an optical store and try on the product or compare its size with a pair of sunglasses you are using.
SUNGLASS FOR GENERAL USE
Sunglasses and protective sun-covers and clip-ons are intended to protect your eyes against the uncomfortable and harmful effects of solar radiation.
Maintenance: do not intend to repair the sunglasses yourself. Consult an expert optician and use original replacement parts.
Storage: keep your sunglasses in a soft or hard case when not in use
Cleaning: Do not use alcohol or substances containing alcohol when cleaning your sunglasses. Use a non-scratching window cleaner and rinse the product with lukewarm water. After rinsing, use a soft, dry cloth, preferable made of microfiber to dry the lenses and frame.
NOTE: The sunglasses are intended for general use and should not be exposed to excessive mechanical or thermal impact.
